Q. What is the correct name of our homeowner’s association?
A. The Valley Property Owners Association, Inc.
Q. Is The Valley POA legally active?
A. Yes. The Oklahoma Secretary of State (click here) shows the Corporation as active and in Good Standing (click here).
Q. If I have two lots, do I have to pay dues on both? Even if it’s 1.5 lots?
A. Article IX of our CCRs as well as 60 O.S. 17 § 851-854 clearly define that owners are liable for dues on each and every lot.
Q. Could The Valley POA reduce the amount of dues liability for second lots?
A. Currently, CCR Article IX § 9.06 requires a Uniform Rate of Assessment meaning all dues must be fixed uniformly for all lots. The CCRs can be amended, however. Read on.
Q. Can we change the CCRs?
A. Absolutely. Article X § 10.03 provides that the CCRs can be amended. The declaration was executed April 5, 1984. Because it has existed for more than 20 years, amendments can be made by a document signed by no less than 75% of the owners. In 1995, 11 O.S. 1 § 42-106.1 was created which actually allows for approval with no less than 60% of the owners.
Q. What are the Common areas?
A. The Valley POA legally has two common areas the first is located near NW 172nd and Valley Ct. on the North side of NW 172nd. Which is known as Common Area C and the second common area starts from NW 172nd and the Chisholm Creek running South along the creek to NW 168th St. Common Area B
